论民事诉讼回避对象的立法缺陷及完善

民事诉讼程序中回避制度的适用对象因受到当事人知情权和被申请主体资格等限制，在实践中无法得到有效的实现。这与我国回避制度的立法思想、立法技术和回避处理程序的行政化有密切关系。我国立法应当与司法改革的成果相适应，适当扩大回避对象的范围，并从程序性质的重新界定、告知制度的细化、制度之间的衔接等方面来保障当事人申请回避权的实现。

Ex ante identification of disruptive innovations in the software industry applied to web applications: The case of Microsoft's vs. Google's office applications

This paper analyzes the question whether web applications pose a disruptive threat to incumbents or a disruptive growth opportunity for entrants in the application software industry using a novel method for ex ante identification of disruptive innovations in the software industry. Building on the theory of disruptive innovations, network effects and existing frameworks for the ex ante identification of disruptive innovations a new method of analysis is deduced. The analysis is based on a list of criteria that indicate a disruptive innovation and trajectory maps of the technologies' performance attributes. This method is applied to study the potential disruption of Microsoft's desktop office applications by Google's web-based office applications.The chosen method of analysis indicates a small likelihood for web applications to pose a disruptive threat to Microsoft, and by extension, to incumbents in the software industry. While web applications show a potential to satisfy market demand in established performance attributes, strong network effects in existing software products should give incumbents enough time to co-opt the innovation. The case illustrates how our new method to analyze disruptive potential in the software industry ex ante can help to apply the theory of disruptive innovation better for forecasting purposes and to provide novel strategic insights for the players involved.

建筑碳排放量是绿色建筑评价的重要指标之一。计算绿色建筑在施工及运行中的碳排放具有重要意义。在对美国堪萨斯大学K.Y.G.Kwok教授等人研发出的绿色建筑碳排放计算器介绍的基础上,对碳排放与绿色建筑之间的关系进行定性分析,并对碳排放计算器计算原理进行了阐述。最后,根据我国的实际情况修改碳排放计算器中的碳排放参数及应用全寿命周期理论来测算材料的碳排放量,为将其应用在国内绿色建筑碳排放计算上提供理论支持。

Effects of employees' perceived dependability on success of enterprise applications in e-business

Electronic business (e-business) plays a major role in modern economic networks due to its shorter cycle time and faster information transactions. Building enterprise applications that can coordinate activities, decisions, and knowledge across many functions is a good solution for e-business. Hence, how to implement enterprise applications successfully has become an increasingly important management issue. Although success of information systems (IS) has received fairly extensive attention from prior research, issues regarding whether functions and service delivered by systems can be justifiably relied on by users are seriously ignored, especially complex systems like enterprise applications. Thus, this paper attempts to extend this kind of concept, perceived dependability, into DeLone and McLean's IS success model to explore how it influences success of enterprise applications. Results from a survey of 170 respondents taken from six internationalized e-businesses in Taiwan strongly support that perceived dependability is indeed an important factor for success of enterprise applications. Additionally, over and beyond the effects of dependability on success of enterprise applications, it can help practitioners and managers get deep insights into how to implement e-business successfully.
